Animal Wellness and Behaviour Pty Ltd DOG TRAINING - Terms and Conditions
By signing this agreement, or by booking or attending any service provided by Animal Wellness & Behaviour (AW&B), you acknowledge that you have read, understood, and agree to be bound by the following Terms and Conditions.
These Terms apply to all AW&B services, including but not limited to private training, group classes, programs, day-trains, and structured daycare.
1. GENERAL TRAINING DISCLAIMER
Dog training is a learning process that requires consistent owner participation. AW&B provides professional guidance, tools, and education; however, training results depend heavily on the owner’s commitment and consistency outside of sessions.
You acknowledge and agree that:
· Results are not guaranteed
· Progress varies between dogs
· Behaviour change takes time and effort
· Training is an ongoing process, not an instant fix
You are engaging AW&B for professional expertise, not guaranteed outcomes.
2. ASSUMPTION OF RISK & LIABILITY WAIVER
You acknowledge that working with dogs - particularly in training, group, or daycare environments - carries inherent risks, including but not limited to injury, illness, behavioural incidents, or property damage.
By engaging in AW&B services this agreement, you:
· Voluntarily assume all risks associated with participation
· Release AW&B, its owners, staff, contractors, and trainers from any liability for injury, illness, loss, or damage sustained by you, your dog, or any third party
· Acknowledge that animal interactions may occur despite all reasonable care being taken
AW&B will not be held financially or legally liable for incidents that occur as a result of normal dog behaviour, environmental factors, or interactions inherent to animal services.
3. DOG HANDLING, SAFETY & BEHAVIOUR
· AW&B reserves the right to require safety equipment (including muzzles) where deemed necessary.
· Failure to comply with safety instructions will result in session termination without refund or credit.
· Trainers retain full authority to end any session, class, or service if safety, welfare, or progress is compromised.
Clients acknowledge that they are engaging AW&B for professional knowledge and assessment, not time-based guarantees. AW&B staff will not require or force dogs to continue training beyond safe or appropriate thresholds.
4. HEALTH, VACCINATIONS & FITNESS TO ATTEND
Owners are responsible for ensuring their dog is:
· Fit, healthy, and injury-free
· Up-to-date with required vaccinations
· Free of contagious illness
Dogs presenting unwell or injured may be refused participation and sent home without refund. Veterinary certification is required for any program pause or refund consideration.
5. CHILDREN & THIRD PARTIES
Children under 16 must be directly supervised at all times. Owners are solely responsible for the safety and conduct of minors and guests.
AW&B is not responsible for injury caused by dogs to children or guests during sessions. Disruptive or unsafe behaviour of minors may result in session termination without credit.
6. BOOKINGS, PROGRAM STRUCTURE & TIME LIMITS
All programs are sold as structured packages, not individual sessions (unless booking a one off).
Time limits apply:
· Kickstart, Private Puppy Program and follow on 3 session package: 10 weeks MAXIMUM
Individual sessions must be completed within one month of payment.
Failure to complete sessions within the timeframe results in forfeiture without refund unless medical documentation is provided and approved.
AW&B reserves the right to terminate services if client compliance, dog suitability, or welfare concerns arise. If terminated by AW&B, a maximum 50% refund of remaining sessions may be issued at AW&B’s discretion.
If, at any time during an active training program, the enrolled dog is rehomed, surrendered, fostered, or ownership is otherwise transferred, the program may be transferred to the dog’s new carer at no additional cost, provided that:
AW&B is notified in writing of the change of ownership
The new carer agrees to and signs AW&B’s current Terms and Conditions
AW&B deems the continuation of the program appropriate and safe
The program is completed within the original program timeframe
Programs are attached to the dog, not the individual owner. Change of ownership does not reset program timelines, extend expiry dates, or alter the scope of services included.
If the above conditions are not met, AW&B reserves the right to terminate the program without refund.
If a dog becomes permanently unfit to continue training due to chronic illness, serious injury, or euthanasia carried out on veterinary advice, AW&B will provide a partial refund for any unused sessions upon receipt of appropriate veterinary documentation confirming the dog cannot continue training.
Where euthanasia is elected without professional agreement, no refund will be issued.
7. PAYMENTS & FEES
· Full payment is required for one off sessions or where program overviews state
· Missed or late payments may result in suspension or termination of services - failed or late payments will be sent to debt collection where additional fees will apply
· Administrative, planning, and preparation time is included in all pricing
8. CANCELLATIONS
· Minimum 48 hours’ notice is required for private training cancellations or to request rescheduling a session
· Late cancellations incur a $80 fee or forfeiture of the session
· Documentation is required to waive fees that clearly state the client or dog was unable to complete the service
· No-shows are forfeited
No refunds or credits for missed classes or daycare visits, or other services.
We require 72hrs notice for group classes rescheduling requests.
9. WEATHER & EXTERNAL FACTORS
Sessions may be rescheduled at AW&B’s discretion due to weather or unsafe conditions. Extensions may be applied; no refunds are issued.
If clients elect to proceed against trainer advice and sessions are interrupted, no credits apply.
10. MEDIA CONSENT
You grant AW&B permission to record photos and videos during sessions for education, documentation, marketing, and promotional purposes across all platforms unless written objection is submitted prior to attendance.
DAYCARE & GROUP SERVICES – ADDITIONAL TERMS
Health & Behaviour
· Dogs in heat are prohibited during designated periods (first heats require 6 weeks off, other heats require 4 weeks off). If dogs arrive at daycare on heat, they will be sent home with no refund - it is the owners responsibility to be monitor this.
· Dogs exhibiting unsafe or unstable behaviour may be removed immediately
· AW&B is not liable for illness, injury, or behavioural incidents during care
Bookings & Cancellations
· Daycare cancellations require 48 hours’ notice
· Group classes are non-refundable
· Day-Trains require 72 hours’ notice
· No-shows are forfeited
Memberships
Memberships operate under contractual commitment and are subject to:
· Limited pauses
· Payment enforcement
· Behavioural suitability
· Pack capacity
AW&B reserves the right to suspend or terminate memberships for safety, behavioural, or payment breaches.
AW&B daycare memberships operate on a standing allocation basis, meaning your dog holds a reserved position within a set pack on nominated days. Membership fees secure your dog’s place, staffing, supervision ratios, and operational planning and are not attendance-based.
As such, membership fees are payable regardless of attendance, similar to a gym-style membership. Non-attendance does not constitute grounds for refunds unless otherwise outlined in these Terms.
To cancel a daycare membership, clients must provide either:
A minimum of two (2) pay cycles’ written notice, OR
Payment of two (2) final membership payments in lieu of notice to terminate immediately
For weekly memberships, this equates to two weeks’ notice or payment. For fortnightly memberships, this equates to two fortnights’ notice or payment.
Membership cancellations take effect only once the notice period or final payments have been fulfilled.
Memberships are based on set attendance days to maintain stable pack structure and safety. While AW&B aims to be flexible where possible, changes are not guaranteed and are subject to availability, capacity, and pack suitability.
For Monday members, AW&B must be notified by 5:00pm on Friday evening if a session needs to be rescheduled or altered for that week. Requests made after this time may not be accommodated.
Failure to attend or notify within the required timeframe does not pause or credit membership fees.
AW&B will make reasonable efforts to accommodate rescheduling requests; however:
Flexibility is discretionary, not automatic
Membership fees will not be refunded or held in lieu where rescheduling is not possible
AW&B reserves the right to decline changes where they impact pack stability, staffing, or safety
Clients acknowledge that the primary purpose of memberships is to maintain consistent pack dynamics, structured routines, and safe handling of dogs within a controlled environment.
Operational Closures, Weather & Unforeseen Circumstances
AW&B services operate in outdoor and live-animal environments and may be impacted by factors outside of our control, including but not limited to adverse weather conditions, extreme temperatures, facility safety concerns, illness outbreaks within packs, or unexpected staffing limitations.
AW&B reserves the right to modify, reschedule, limit capacity, or temporarily suspend services where continuing operations may compromise dog welfare, staff safety, or service quality.
Where AW&B elects to cancel or suspend a casual booking due to the above circumstances, a credit will be issued to the client’s account. Credits must be used within three (3) months from the original booking date. No refunds will be provided.
Where services are temporarily suspended, membership payments will be placed on pause. Any payments processed during a closure period will be credited or offset against the next scheduled membership payment, ensuring members are not financially disadvantaged.
Daycare & Group Services – Assumption of Risk
By enrolling in AW&B daycare, group classes, social days, or any other group-based services, you acknowledge and accept that these services involve direct interaction between dogs. Despite AW&B upholding high standards of supervision, handling, risk assessment, and safety protocols, interaction between animals carries inherent and unavoidable risks.
You understand and accept that dogs may engage in play, correction, social learning, or behavioural responses that can result in injury, illness, stress, behavioural incidents, or property damage. These risks exist even where reasonable care and professional supervision are applied.
By enrolling your dog in group-based services, you voluntarily assume all risks associated with dog-to-dog interaction and release Animal Wellness & Behaviour, its owners, trainers, staff, and contractors from any liability for injury, illness, behavioural changes, incidents, or loss that may occur during or as a result of participation in these services.
This acknowledgement applies regardless of the level of care, supervision, or preventative measures in place and includes incidents resulting from normal canine behaviour.
FINAL ACKNOWLEDGEMENT
By signing or booking services with AW&B, you confirm that you:
· Understand the risks involved
· Accept full responsibility for your dog
· Agree to comply with all staff instructions
· Release AW&B from liability to the fullest extent permitted by law
